The judge passed the order on the petition of Peoples Unity of PIA Employees Secretary General Muhammad Ashraf Bhulloo and issued notices to the respondents with direction to the PIA management and Amir Shah to file a reply within one week.
The petitioner, through his counsel MA Chaudhry, had challenged a parallel cabinet of the union allegedly formed by Senator Faisal Raza Abdi to protect the PPPís vested interests in the PIA as political in-charge of the airlinesí affairs. Mr Bhulloo submitted that bogus office-bearers of the union, backed by Senator Abdi, were ousting the duly elected officer-bearers of the union from the offices in Lahore, Karachi, Islamabad and other cities.
Ashraf Bhulloo said the PIA unionís elections were held after every three years as per its constitution and the genuine union cabinet, headed by its President Kamran Chaudhry, had still one year to complete in office. Mr Abdi did not wait for one year for the new cabinet and violating the union constitution, chose a new cabinet body of his likeminded people without polls, he alleged.
The petitioner said Senator Faisal Raza Abdi was appointed as political in-charge of the PIA employees by President of Pakistan Asif Zardari through a notification issued on August 16, 2010. He alleged that Abdi, taking advantage of the notification, with the connivance of the PIA management had hatched a conspiracy against the CBA union and with the help of 30 outsiders non-workers ousted the duly elected officer-bearers of the union at the Karachi airport and put his own men at the offices of the union by conducting the polls. He said the managing director (MD) and chairman of the PIA also helped Abdi in the plan, adding that the MD and PIA chairman, who was the defence minister, attended the meeting and gathering arranged by Abdi at Lahore Airport on November 5, 2010 for dummy polls. The PIA chairman and MD, siding with Abdi, announced new cabinet of the CBA union in violation of the constitution of the union and got the same cabinet approved by the NIRC chairman on December 30, 2010.
Ashraf Bhulloo filed the petition on December 31 and it was fixed for hearing on the same date and the court, after hearing arguments of the petitionerís counsel, issued stay, restraining new cabinet from its operation and freezing unionís accounts till the court verdict.
